Yes, it does replace the Federal Income Tax. The actual legislation is written such that the 16th Amendment must be repealed before the FairTax can be instituted. The 16th Amendment states, “The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.” Without the 16th Amendment, Congress has no such right, thus income taxes would be history.

Slight error here. The act repeals the law establishing the internal revenue service. The fairtax would be implemented after the irs is repealed. The amendment to the constitution is sent to the states concurrent with approval of the fairtax.

Bladen, the language of the 16th Amendment (quoted above) doesn’t establish the IRS, it just makes it lawful for Congress to “lay & collect” income taxes. No language in reference as to how or through what agency – especially since the IRS didn’t exist at the time. (Also no language as to it being unlawful for citizens NOT to pay those taxes, thus all the kooks out there trying to tell you you can beat it in court…)

What the FairTax Act does is repeals this amendment, thus removing income taxes. Further, there is language in the FairTax Act which makes it unlawful for income taxes to be reinstated as long as the FairTax is in effect.
